Collection and Delivery of Goods Agreement

 

I

Definitions

(i)

"GV Transport Limited" (Company No 6820387) is a shipping and freight forwarding company trading under the name of "GV Transport", whose office is located at 84 Creffield Road, London, W3 9PX, England, hereinafter referred to as "GV Transport".

(ii)

"Consignment" shall mean any article that is intended to be carried by "GV Transport" and delivered according to the terms set out in the shipping note.

(iii)

"Shipping Note" shall mean any document or label that specifies the consignment and can refer to several articles.

(iv)

The Shipping Note contains all the data as given by the "customer" when making the order: name, surname, their return address and that of the recipient ("consignee"), telephone numbers of customer and consignee, weight of consignment measured at the collection point, cost of transportation, date, time and place of collection and delivery, signatures of sender and consignee. The shipping note also has a brief statement of the contents of the consignment. A sample of the shipping note is available on demand.

(v)

"Customer" shall mean a person(s) requesting "GV Transport" to transport the consignment.

(vi)

“Sender” shall mean any person older than 18 years of age specified on the Shipping Note responsible for delivering the consignment to GV Transport.

(vii)

"Consignee" shall mean a person(s) authorised to receive the consignment as specified in the shipping note.

(viii)

Delivery and transfer of the consignment to the consignee will take place only at the time and place specified on the shipping note.

II

Delivery Schedule

(i)

Consignments will be delivered to the destination between the fourth day and the tenth day after the date of departure. The key dates of departure will be reported on the company’s website www.gvtransport.co.uk

(ii)

GV Transport will not be liable for the delayed delivery of consignments caused by Any Act of God for the duration of which this contract will be suspended. Unavoidable changes of times of delivery will be reported to the customer.

(iii)

An Act of God means any event irresistible and unpredictable amounting to natural disaster, industrial action, lockouts, weather conditions, traffic congestion, mechanical breakdown or obstruction of any public or private road or highway or any cause whatever beyond the control of GV Transport.

III

Orders

(i)

GV Transport will accept orders via the following means:
a) Order Form on the website (www.gvtransport.co.uk),
b) Email Addresses specified on the website/Advertisements,
c) Telephone or Fax
d) In person at the Company Office.

(ii)

To validate the order stage, Customers must provide all the information specified on the shipping note.

IV

Insurance:

(i)

Items with a commercial value of £100.00 are covered by insurance incorporated in delivery fees. Items with value higher than £100.00 will require an additional insurance fee of 1% for every £100.00.

V

Collection & Packaging:

(i)

All items must be securely protected prior to submission to GV Transport. Fragile items must be marked ‘FRAGILE’ in large bold font and be displayed on all sides of the outer package. Fragile items must be held secure in bubble-wrap, polystyrene or other similar means of ensuring optimal protection. Fragile items must be clearly marked as such and it is the sender’s sole responsibility to ensure the secure packaging of such items. Items marked ‘FRAGILE’ will incur an additional handling charge.

(ii)

By accepting any goods GV Transport does not invalidate the Customer’s prior responsibility of safe and secure packaging prior to collection. GV Transport reserves the right to refuse acceptance of items which are not packed to comply with reasonable safety standards and which cannot be transported with a reasonable standard of care.

(iii)

Each consignment must be clearly labeled with the complete and valid addresses of the sender and the recipient.

(iv)

For security purposes, GV Transport reserves the right to screen all items by X Ray machines or other monitoring devices in order to confirm the identity of such items and suitability for transport. GV Transport reserves the right to refuse delivery of and return to the customer, any items either undeclared or incorrectly specified or considered unsafe for transport.

(v)

For security purposes articles may be sealed by the sender's personal signature, stamp, seal or other specific mark over the edges and closures of the package. THE CONSIGNMENT MUST BE PROTECTED AGAINST CRACKING, PACKAGED IN A PLASTIC FILM AND BOUND WITH A TAPE. OPENINGS MUST BE REINFORCED WITH TAPE OR LOCKED.

VI

Collection and Delivery

(i)

All consignments will be collected by the GV Transport driver at the sender's address as listed on the Shipping Note, or at another expressly agreed place of collection. If any additional documentation or customs declaration of the consignment is needed, it is The sender bears every responsibility to submit all relevant documentation pertaining to Customs Declarations to the GV Transport driver at collection.

(ii)

Upon delivery of the consignment the GV Transport driver will hand over a copy of shipping note as laid out in point 1 of these Freight Terms and Conditions.

(iii)

GV transport will inform the recipient of the time of arrival by text message or telephone call at least 12 hours prior to the delivery of the consignment. Any expected delay towards delivery of the shipment will be communicated to the sender and to the recipient as soon as such delay is reasonably foreseeable.

(iv)

Upon delivery of the consignment to the consignee, the GV Transport driver will specify the date and time of delivery on the shipping note. The recipient of the consignment will acknowledge its receipt with their signature, confirming the date and time of delivery. The consignment will not be delivered to any person(s) other than those listed on the shipping note, unless a written agreement states otherwise.

(v)

In the event that the recipient is not present at the address specified in the shipping note at the agreed time, the sender will be contacted by the GV Transport driver to re- arrange delivery. In the event that re-delivery is requested, GV Transport will deliver the consignment at the agreed time and place. A re-delivery charge of 400 Kc (13GBP), will be paid by the consignee on delivery of the consignment.

(vi)

If it is not possible to deliver the consignment for any reason or if the recipient refuses to accept it, GV Transport will immediately inform the sender, and if a re­delivery cannot be arranged, the consignment will be returned to the sender, and the sender will be liable to pay for the transport to the return address.

(vii)

For safety reasons at collection and delivery of the consignment the GV Transport driver must not go more than 10m from the GV Transport vehicle, and must keep the vehicle in sight at all times.

(viii)

If handling overweight consignments (more than 30 kg) the assistance of the sender and the recipient is required, or the articles will not be carried.

VII

Shipping Costs

(i)

Shipping costs are payable in local currency as listed on the website www.gvtransport.co.uk

(ii)

Shipping costs and Stamp Service charges are payable either in advance by the sender in cash to the GV transport driver at the time of collection, or by the consignee as specified on the shipping note.

(iii)

Shipping costs can be paid through PayPal or Moneybookers.

(iv)

Other ways to pay are bank transfer and cheque, provided that payment takes place beforehand

VIII

Exclusions

(i)

The following are excluded from transportation: articles that contain live animals; dangerous, combustible, self - igniting and explosive goods; ammunitions; weapons; chemicals; radioactive materials; poisonous, infectious and similar materials that could during transportation endanger life and health of another road users or damage other consignments. Articles must not contain cigarettes, alcohol, or perishable products which need transportation in chilled or frozen state or products with very short life-spans.

(ii)

The customer is responsible for giving the correct information to be listed in the shipping note, and in declaring the content of the consignment. In the event that GV Transport discovers that the content of the consignment differs from the content declared in the shipping note, GV Transport has the right to refuse transportation and return that consignment at the expense of the customer. The customer will be liable for all claims, charges, fees, damages, fines and expenses incurred by GV Transport if the shipment is deemed to be excluded, and will also loose their right of compensation for damage to or late delivery of the consignment.

IX

Complaints

 

It is the customer's obligation to make any relevant complaint (loss, damage or delay of consignments) to GV Transport within 24 hours of delivery of the consignment or from the time delivery was advised. Once the Recipient has confirmed delivery with his signature no complaints shall be considered.

GV Transport will pay compensation in the event of proven claims without delay. GV Transport is fully insured for claims on its behalf.
